New marijuana ordinance faces legal roadblocks

A judge has tapped the breaks on a revised marijuana ordinance that was passed by Port Huron voters this week. Circuit court Judge Cynthia Lane has issued a temporary restraining order, saying Tuesday’s ballot proposal cannot take effect until a hearing is held. The restraining order comes after the City of Port Huron complained that the amended ordinance would violate the rights of those who were issued a recreational marijuana license under the previous ordinance. Passed by 58% of the voters Tuesday, the new ordinance would replace the scoring system used to determine which applicants would be granted a license, and provides a new scoring system that gives preference to medical marijuana stores. A hearing in St. Clair County Circuit Court is expected to occur on August 19th.
